The Local Government (Access to Information) (Variation) Order 2006, which came into effect on 1 March 2006, requires the Council to consider whether maintaining the exemption listed above outweighs the potential public interest in disclosing the information. Minutes: The Licensing Sub-Committee considered an application for a Street Trading Consent under the Local Government Miscellaneous Provisions Act 1982. The three councillors that presided over this item were Councillors R Morgan (Chairman), P Keska and M George. Cllr E Gabbett observed the meeting. Also present were N Sayers (Legal Officer), D King (Licensing Manager), D Houghton & P Jones (Licence Officers), T Larsen (Democratic Service Officer) and R Moreton (Webcaster).
The Chairman welcomed the applicant and introduced the members and officers present.
The Licensing Officer informed the Sub-Committee of the circumstances under which the licence could not be dealt with under delegated authority.
The applicant made a short statement in support of the application before answering questions from members of the Sub-Committee and the objector.
The Objectors from Loughton Resident Association made their statement.
The Applicant made his closing statement.
The Panel retired to consider the application.
The Chairman invited the applicant, Licensing Officers and objector back into the chamber and informed the applicant of the Sub-Committee’s decision.
DECISION:
The decision of the sub-committee is that the Consent shall be granted subject to the following conditions:
1. This Authority’s standard conditions.
2. The sale of Artwork.
3. Trading hours:
a) Monday to Saturday 09:00 – 18:00 b) Sunday 09:00 - 17:00 c) The Consent holder must ensure that business operations from the licences area align with existing local business arrangements and charters, including regular markets and street trading consents.
4. The public area immediately surrounding the stall shall be regularly cleared of waste, wrapping etc, and left in a tidy state at the end of trading on each day.
5. The consent is permission to trade from a portable stall. The stall must be no larger than 3x3 meters in size and removed at the end of each day of trading and situated and operated from the street location on the pavement outside 214 High Road, Loughton.
