The Local Government (Access to Information) (Variation) Order 2006, which came into effect on 1 March 2006, requires the Council to consider whether maintaining the exemption listed above outweighs the potential public interest in disclosing the information. Any member who considers that this test should be applied to any currently exempted matter on this agenda should contact the proper officer at least 24 hours prior to the meeting.

 

Background Papers:  Article 17 - Access to Information, Procedure Rules of the Constitution define background papers as being documents relating to the subject matter of the report which in the Proper Officer's opinion:

 

(a)        disclose any facts or matters on which the report or an important part of the report is based;  and

 

(b)        have been relied on to a material extent in preparing the report and does not include published works or those which disclose exempt or confidential information and in respect of executive reports, the advice of any political advisor.

 

The Council will make available for public inspection for four years after the date of the meeting one copy of each of the documents on the list of background papers.

Change of Order of Agenda

Minutes:

The Licensing Compliance Officer advised that first applicant had not arrived and asked that the agenda be reordered so that the applicant’s in attendance could be heard first.

 

Resolved:

 

That the Sub-Committee agreed to the change in order of the agenda.

Local Government (Miscellaneous Provisions) Act 1976 as amended & Town & Police Clauses Act 1847 - Application for a Hackney Carriage Driver's Licence - Mr V M Carvalho

(Director of Neighbourhoods) To consider the attached restricted report.

Minutes:

The Sub-Committee considered an application by Mr V M Carvalho for a Hackney Carriage Driver’s Licence. The three Councillors that presided over this item were Councillors R Morgan, J Jennings and N Bedford. Members noted that Officers did not have delegated powers to grant this application and, as a result, the application had to be considered by the Sub-Committee.

 

The Chairman welcomed the Applicant and introduced the Members and Officers present. The Licensing Compliance Officer informed the Sub-Committee of the circumstances by which the licence could not be issued under delegated authority.

 

The Applicant made a statement in support of his application before answering a number of questions from Members of the Sub-Committee. The Applicant then made a short closing statement to the Sub-Committee before the Chairman requested that the Applicant leave the Chamber whilst the Sub-Committee debated the application in private.

 

The Chairman invited the Applicant back into the Chamber and informed him of the Sub-Committee’s decision.

 

RESOLVED:

 

That the application for a Hackney Carriage Driver’s Licence for Mr V M Carvalho be granted subject to Council’s standard terms and conditions.

Minutes:

The Licensing Compliance Officer advised that Mr Ali was not present. Members requested that the meeting be adjourned so that the Licensing Compliance Officer could contact the applicant to find out whether he would be attending the meeting.

 

            RESOLVED:

 

That the meeting be adjourned at 10.55 a.m. and re-convened at 11.10 a.m. for the purposes of considering his application.

Minutes:

The Licensing Compliance Officer advised that she was unable to contact and confirm whether Mr Ali would be attending the Sub-Committee. Members were advised that this was the second occasion where he had failed to attend the Sub-Committee.

 

The Sub-Committee were asked to consider whether to continue, suspend or revoke the current Hackney Carriage Driver’s licence for Mr M Ali. The three Councillors that presided over this item were Councillors R Morgan, J Jennings and G Shiell. Members noted that Officers did not have delegated powers to grant this application and, as a result, the application had to be considered by the Sub-Committee.

 

The Sub-Committee considered the information and asked the Licensing Compliance a number of questions.

 

RESOLVED:

 

That the application for a Hackney Carriage Driver’s Licence for Mr M Ali be suspended until he attended a Sub-Committee.
